EXPLANATORY NOTES FOR THE PERMANENT EMPLOYMENT AGREEMENT WITH A PROBATION PERIOD

This agreement is for use by employers who wish to employ employees on a long-term basis, and can be used in a number of different industries, e.g. when hiring an employee in a corporate, a teacher, an estate agent etc. It is robust and flexible enough to be used for the most junior to the most senior of employees.

It can be easily used where employees are paid a monthly salary, a commission, or a basic salary and commission.

This agreement has a probation period built into it. We advise employers to use probation periods prudently and in good faith. Some employers mistakenly believe that the probation period is something that allows them to dismiss an employee once the probation period is over. There is an abundance of legal guidance on the latter issue and we advise employers to apprise themselves of such. Treating an employee incorrectly and dismissing him/her incorrectly once the probation period is over, could result in the employer facing legal action in the CCMA, with a concomitant loss of money AND reputational risk.

Instead of having a probation period in a contract an employer may opt to purchase the long-term employment contract for sale on this site that does not contain a probation period.

  2. is bordered;
  3. has pages numbered;
  4. is fully justified;
  5. is typed up using Tahoma font, size 10;
  6. has been meticulously spell-checked;
  7. is extremely professional in its appearance;
  8. has several drafting and explanatory notes therein for guidance;
  9. can be printed onto 9 A4 pages. (In the interests of the environment, it is suggested that the agreement be printed back to back on 4 pages.)
